THE PENNSYLVANIA LOTTERY'S
PA iLOTTERY SYSTEM
TERMS AND CONDITIONS OF USE AND ACCOUNT AGREEMENT
- Introduction.
The Pennsylvania Lottery is authorized to offer Lottery Products and Lottery Games through the PA iLottery System pursuant to 4 Pa.C.S.A. § 501 et seq., the State Lottery Law, 72 P.S. § 3761-101 et. seq., and the Lottery's regulations, 61 Pa. Code §§ 801 et. seq. The Lottery has contracted with Scientific Games, LLC to provide software, Services and Promotions related to and available through the PA iLottery System. By creating a Lottery Account through the PA iLottery System, individuals at least 18 years of age and physically located in the Commonwealth of Pennsylvania at the time of play, can purchase Products and Plays, and utilize Services through their Lottery Account. These PA iLottery System Terms and Conditions govern the use of the software and Services offered through the PA iLottery System.
The Parties, intending to be legally bound hereby, agree as follows: - Definitions.
The following definitions are applicable to the PA iLottery System Terms and Conditions of Use and Account Agreement:
"Draw" means a Lottery Product, sold at brick-and-mortar retailers and through the PA iLottery System, where a player selects from a designated set or sets of numbers which match all or a specified combination of the winning numbers in a drawing conducted by the Lottery, or another party designated by the Lottery.
"Fast Play" means instant win Lottery Product sold at brick-and-mortar retailers, which is printed from a Lottery terminal, that is not preprinted, and where there is no coating to remove or a drawing to determine the identity of a prize-winning ticket.
"Funding Account" means the financial account, instrument, or access device, approved by the Lottery, connected and associated with Your Lottery Account through which You will deposit funds for the exclusive purpose of Your purchase of Products.
"Game" or "Games" means internet instant games and other Products offered through the PA iLottery System.
"Instant" means a Lottery Product, also referred to as a scratch-offs, sold at brick-and-mortar retailers, which is preprinted, and where there is a coating to remove to determine the identity of a prize-winning ticket.
"Lottery Account" means an account established and accessed through the PA iLottery System, which may be used to purchase Products and Plays and to participate in Promotions, Second-Chance Drawings and other Lottery events and offerings.
"PA iLottery System" means the Lottery's online gaming system comprised of and accessed through the PA iLottery website (PAiLottery.com), any Lottery mobile platforms, and mobile-optimized PA iLottery website.
"Parties" means the Pennsylvania Lottery and the user or owner of a Lottery Account.
"Pennsylvania Lottery," "Lottery," or "the Lottery' means the bureau of the Pennsylvania Department of Revenue which is responsible for the administration of the Pennsylvania State Lottery.
"Play" or "Plays" means an opportunity, for a predetermined price, to participate in a Game. The term also includes chances or shares.
"Products" means Plays, shares or chances offered by the Lottery as well as Lottery property that may be exchanged for Plays, shares or chances. The term includes, but is not limited to, instant tickets, terminal-based tickets, raffle games, play-for-fun games, Lottery vouchers, Subscriptions and gift cards authorized for sale under the State Lottery Law.
"Promotions" means marketing initiatives designed to enhance player engagement by offering bonuses, coupons and other rewards.
"Second-Chance Drawings" means opportunities to win a prize in a drawing conducted by the Lottery by entering non-winning Instant and Fast Play game tickets, as well as winning or non-winning draw game tickets.
"Secretary" means the Secretary of the Pennsylvania Department of Revenue.
"Services" means the activities, uses or benefits provided by the Lottery to a Lottery Account holder through the PA iLottery System including, but not limited to playing Games, managing the Lottery Account, depositing cash, withdrawing prizes, geolocation, ID verification and customer service.
"Subscription" or "Subscriptions" means a payment, advance payment or promise of payment for multiple Products over a specified period of time, including payment through the PA iLottery System.
"Terms and Conditions" means the PA iLottery System Terms and Conditions of Use and Account Agreement as periodically revised by the Lottery.
"VIP Players Club" means a collection of players who register with the Lottery to participate in various Lottery Promotions, and to receive jackpot alerts, winning number alerts and various special offers related to Lottery ticket purchases.
"WebCash" means a Product sold at brick-and-mortar Lottery retailers, which may be purchased and used to fund a player"s Lottery Account with the amount of the WebCash purchased.
"You" and "Your" means the user or owner of a Lottery Account. - Terms and Conditions Subject to Change.
These Terms and Conditions may be modified from time to time and without prior notice in the sole discretion of the Lottery. All changes are effective immediately upon the date the changes are published to the PA iLottery System. Your continued use of the PA iLottery System confirms your acceptance of these Terms and Conditions applicable at the time You access and play via the PA iLottery System. If You do not agree to these Terms and Conditions at the time You access and play via the PA iLottery System, You must discontinue Your use of the PA iLottery System immediately. - Additional Terms.
Additional terms and conditions may apply to Your use of the PA iLottery System and the Products, Plays, and Services available through the PA iLottery System. These additional terms include, but are not limited to, Game descriptions and rules, Game notices, Promotion rules, Second-Chance Drawing rules, third party payment processor terms and conditions, and geolocation services terms and conditions. - Age Eligibility Requirement.
It is unlawful for anyone under the age of 18 to register for a Lottery Account through the PA iLottery System or to purchase a Product through the PA iLottery System. By establishing a Lottery Account, You are certifying to the Lottery, that You are at least 18 years of age. The Lottery reserves the right, in the Lottery's sole discretion, to request proof of Your age at any time during Your use of the PA iLottery System. The Lottery will terminate Your Lottery Account and exclude You from using the PA iLottery System if proof of age is not provided upon request or if the Lottery confirms You are under the age of 18. - Geolocation Requirements.
You must be physically located within the geographic boundaries of the Commonwealth of Pennsylvania at the time You purchase Products or Plays or utilize Services through the PA iLottery System. By registering for a Lottery Account, You agree to only purchase Products and Plays and utilize Services through the PA iLottery System while physically located within the geographic boundaries of the Commonwealth of Pennsylvania. Furthermore, You consent to the Lottery confirming, monitoring, and recording Your physical location each time You login to Your Lottery Account and during Your use of Your Lottery Account.
By registering for a Lottery Account, You agree that You will comply with the Lottery's requirements in connection with verifying Your physical location at time of play, including by use of Your device"s location or through the use of Wi-Fi networks when You use Your mobile device, or both. Utilizing the PA iLottery System may require You to download the geolocation service used by the Lottery and/or its contractors or suppliers.
If the Lottery is unable to verify that You are physically located within the geographic boundaries of the Commonwealth of Pennsylvania, Your access will be blocked, and You will be prohibited from initiating any purchase of Products and Plays.
If You initiate a purchase through the PA iLottery System while physically located outside the geographic boundaries of the Commonwealth of Pennsylvania, the Lottery reserves the right to any of the following remedies: deem Your purchases invalid, refuse to award prizes, reclaim awarded prizes, or terminate Your Lottery Account.
The Lottery is not liable for any damages or losses resulting from any failure of the geolocation technology or Your inability to access the Services because of that. The Lottery will not check Your location after You leave the PA iLottery System. - Purchase and Prize Restrictions.
You are prohibited from registering for a Lottery Account, purchasing Products or Plays, winning prizes, or utilizing Services through the PA iLottery System if: You are an officer or employee of the Lottery; You are the spouse, child, brother, sister, or parent residing as a member of the same household as an officer or employee of the Lottery; You are an officer or employee of a contractor or subcontractor who is directly involved in the operation of the Lottery or the provision of the Lottery related Services; or You are the spouse, child, brother, sister, or parent residing in the same household as an officer or employee of a contractor or subcontractor who is directly involved in the operation of the PA iLottery System and the provision of iLottery related Services. - Lottery Accounts.
Registering for a Lottery Account. In order to purchase Products or Plays or utilize Services through the PA iLottery System, You are required to create a Lottery Account. To establish a Lottery Account, You are required to provide: Your name as it appears on a valid government-issued identification or tax documents; Your date of birth; the last four digits of Your Social Security number; Your physical address; Your telephone number; Your email address; and any other information necessary to verify Your age and Your identity, as determined by the Secretary. You consent and agree to the Lottery using third-party verification services to verify the personal information that You provide. You certify that the information You provide regarding Your Lottery Account is accurate and complete at the time of creating the Lottery Account and thereafter.
You are solely responsible for maintaining accurate Lottery Account information and the Lottery will not be responsible for any inaccuracies in Your Lottery Account or the timeliness of processing updates to Your Lottery Account information, or the Lottery's reliance upon the information. You hereby expressly agree to fully cooperate with the Lottery in the verification of the personal information You provide during the Lottery Account registration process and at any time thereafter.
In order to confirm Your Lottery Account information You provided during the creation of Your Lottery Account, or the information as periodically updated by You, the Lottery reserves the right to request and You agree to provide certain documentation including: Your driver"s license or other valid government-issued identification card or passport; proof of address, such as a utility bill; or proof of a payment method. You will not be permitted use of the PA iLottery System unless and until Your age and identity have been verified to the Lottery's satisfaction. The Lottery does not guarantee the timeliness of processing updates to Your Lottery Account.
Agreement to Monitor and Record. You agree to allow the Lottery to monitor and record Your wagering communications, electronic communications and geographic location information during Your use of the PA iLottery System.
Funds Will Not Earn Interest. Monies held in Your Lottery Account will not earn interest.
Account Statements. You may review Your most recent Lottery Account statement detailing Your Lottery Account activity. The Lottery Account statements are for convenience only and do not establish a transaction, winning Play, winning ticket or prize. It is Your responsibility to notify the Lottery immediately of any errors in Your Lottery Account statement. Your Lottery Account statement only includes purchases made through Your Lottery Account.
VIP Players Club Membership. Your Lottery Account includes membership to the VIP Players Club. As a VIP Players Club member, You must agree to receive VIP Players Club Membership communications by one or more of the following modes of communication: email, phone, text message or through Your Lottery Account. These communications may include, but are not limited to, Lottery Account information, marketing information, promotional information, special offers, coupons for Products or other information from the Lottery. You may change Your communication preferences and opt-out of certain modes of communications that You selected during the Lottery Account creation process at any subsequent time. If You initially choose not to receive communications via additional modes of communication, You can elect to receive communications at any time by adjusting Your communication settings.
Account Transactions. By registering for a Lottery Account, You agree that Your Lottery Account is for Your sole personal use and that You will safeguard and maintain the security and confidentiality of Your email address and password. All transactions initiated after Your email address and password have been entered correctly to access the PA iLottery System will be regarded as valid whether or not authorized by You.
Account Adjustments. You agree that the Lottery may make adjustments to Your Lottery Account balances when funds are mistakenly credited to or deducted from Your Lottery Account by the Lottery, when necessary to correct inaccuracies when identified by You or the Lottery, or when it has been determined that Your purchase or Your receipt of a prize was in violation of applicable law, regulations, Lottery policies, rules, or these Terms and Conditions. The Lottery may cancel or reclaim prizes when the Lottery determines that taxes or statutory offsets as more fully described herein, are required.
Inactive Accounts. If You do not access Your Lottery Account by entering Your email address and password to gain access to Your Lottery Account, at any time during a period of three consecutive years, Your Lottery Account will be considered abandoned. Pursuant to applicable law, once a Lottery Account is deemed abandoned, any moneys remaining in Your Lottery Account and any pending wagers associated with Your Lottery Account will be considered abandoned and unclaimed property. Abandoned and unclaimed property will be reported and transferred to the Pennsylvania Department of Treasury.
Account Suspension or Termination by You. You may terminate or suspend Your Lottery Account at any time by contacting the Lottery at 1-833-530-7529 or [email protected]. Termination or suspension of Your Lottery Account will occur within five calendar days after the Lottery's receipt of Your communication requesting termination or suspension of Your Lottery Account. Termination or suspension of Your Lottery Account will prohibit You from entering Second-Chance Drawings and other Promotions, and events offered exclusively through the PA iLottery System. Please note consistent with applicable record retention, legal, and information security requirements, some of Your Lottery Account information will be retained post termination.
Account Suspension or Termination by the Lottery. The Lottery may suspend or terminate Your Lottery Account for any of the following reasons: You request suspension or termination; the Lottery decides to discontinue to provide the Products, Plays or Services offered exclusively through the PA iLottery System; the Lottery believes You have breached any of these Terms and Conditions, as required by applicable regulations or applicable law; any use of the PA iLottery System or any Lottery Account has been determined by the Lottery to be unlawful, fraudulent or improper; Your Lottery Account is in any way associated with an existing Lottery Account; upon instruction from an law enforcement agency or regulatory body; to comply with applicable law or an order by a court of competent jurisdiction; or You have been charged with or convicted of an offense under 18 Pa.C.S.A. §§ 903 (relating to criminal conspiracy to commit any of the following criminal offenses), 4106 (relating to access device fraud), 5512 (relating to unlawful lotteries), 5513 (relating to gambling devices and gambling), or 5514 (related to pool selling and bookmaking), or equivalent crimes under federal law or the law of another jurisdiction.
Remaining Balances. Upon termination of Your Lottery Account for any reason, any balance in Your Lottery Account to which You are entitled will be paid to You via check mailed consistent with Your Lottery Account information within a reasonable time, subject to the Lottery's right to deduct any amounts owed by You to the Lottery. - Payment Transactions.
Third-party payment processors. The Lottery reserves the right, in its sole discretion, to use third-party electronic payment processors, payment transmitters and/or financial institutions to process payments authorized and made by You to the Lottery and initiated by the Lottery to You in connection with Your use of the PA iLottery System. In the absence of conflict with these Terms and Conditions, You agree to be bound by the terms and conditions of such third-party electronic payment processors, payment transmitters and/or financial institutions utilized by the Lottery. You are solely responsible for any transaction fees or penalties of any kind imposed by any payment processors, payment transmitters, financial institutions or any other third-party utilized by the Lottery associated with processing of Your purchases or transactions and any transaction fees or penalties assessed by Your financial institution associated with Your Funding Account.
Funding Account Source. Each deposit into Your Lottery Account via Your Funding Account must be from a single payment source approved by the Lottery, including, but not limited to, a credit card, a debit card, or a pre-paid card on which You are named the primary account holder. The Lottery reserves the right to establish daily limits for deposits into Your Funding Account from credit cards or other payment sources approved by the Lottery.
Unless required by law, funds You deposit into Your Lottery Account via your Funding Account cannot be withdrawn, returned, charged-back, re-credited, or transferred to another account. It is Your responsibility to refrain from depositing more than You intend to use through Your use of the PA iLottery System. You agree that You will not attempt to deny, reverse, charge-back, re-credit, block or otherwise attempt to invalidate, recover, or deny the Lottery receipt of a deposit. You hereby authorize the Lottery to hold and collect any amount owed to the Lottery as a result of any fees, taxes, statutory offsets or penalties from Your deposits or prize winnings. The Lottery reserves the right to pursue any other means to recover such losses.
Withdrawal Requests. When You wish to withdraw cash prizes won from Your Lottery Account, payments generally will be made within 8 to thirteen business days. You may not withdraw funds You deposit for play or wager via Your Funding Account or bonus money from Your Lottery Account. Funds deposited must be played. You may be required to provide certain information regarding Your identity or Your Funding Account before the withdrawal request is processed by the Lottery. Further, to the extent Your Funding Account source does not allow the Lottery to credit withdrawn moneys to that funding source, You may be required to provide the Lottery with a separate withdrawal mechanism or You will receive payment from the Lottery by check.
You understand and agree that the Lottery may hold any withdrawal if it is suspected that You may be engaging in or have engaged in fraudulent, collusive, unlawful, or improper activity pending completion of an investigation. You agree to cooperate in any investigation into such activity. You understand and agree that Your refusal to cooperate with an investigation may lead to a hold being placed on Your withdrawal. The Lottery is not liable for any damages or losses resulting from any delay or denial of a withdrawal resulting from an investigation.
WebCash. WebCash vouchers may only be redeemed for the full value of the voucher. You have the sole responsibility for checking the accuracy and condition of the data printed on Your WebCash voucher. The Lottery is not responsible for lost or stolen WebCash vouchers. To be a valid WebCash voucher, the WebCash voucher must have been validly issued, the WebCash voucher data must have been recorded on the Lottery's central computer system, the PA iLottery System, and the WebCash voucher data must match the computer records in every respect. A WebCash voucher not passing the Lottery's validation requirements will be considered invalid and no deposit will be credited to Your Lottery Account. The determination of the Secretary in this regard is final. - Purchases.
Sufficient Funds Required. You are responsible for funding all purchases made through Your Lottery Account. You must have sufficient funds available in Your Lottery Account to make a purchase. Initiating a purchase through the PA iLottery System constitutes Your authorization and agreement for the Lottery to deduct the cost of that purchase from Your Lottery Account.
All Sales are Final. Your purchases of Products or Plays or Your use of Services may not be cancelled. Cancellation of subscriptions may only occur prior to a scheduled purchase. You are solely responsible for ensuring You have selected the correct Product and all options associated with that Product, including but not limited to: the Game; the number of Plays; the purchase price of the Play(s); and the numbers or selections chosen on any Play at the time of purchase. Purchases made in error will not be refunded. - Claims for Winning Prizes.
For Draw Games available through the PA iLottery System, the prize must be claimed within one year of the drawing date. Unless otherwise specified, all other Lottery prizes for Products available through the PA iLottery System are claimed automatically using Your Lottery Account information. It is Your responsibility to ensure Your Lottery Account information is up-to-date and accurate.
You may be required to complete a Lottery claim form and to submit that claim form in person at a Lottery claim center designated by the Lottery for draw game prizes of $1 million or greater.
Prizes or portions thereof won through Your Lottery Account will remain payable at the time of death of a prize winner. Upon payment of a prize as provided in this section, the Lottery will be absolved of further liability. Under no circumstances will the payment of prizes be accelerated before their normal date of tender or payment because of the death of a prize winner.
(1) Prizes or portions thereof not payable by an annuity contract will be payable to a designated beneficiary which the deceased prize winner may appoint by will. If a deceased winner of a prize not payable by an annuity contract fails to designate a party specifically or by residuary clause or fails to exercise a power of appointment in a will, then payment will be made directly to those parties who would succeed to the assets of the deceased prize winner under 20 Pa.C.S.A. Chapter 21 (relating to intestate succession).
(2) Prizes or portions thereof payable by an annuity contract will be payable to the party designated as a beneficiary on the latest valid beneficiary statement on file with the Lottery. If a winner of a prize or portion thereof payable by an annuity contract dies before completing a valid beneficiary statement or does not have a valid beneficiary statement on file with the Lottery at the time of death, then the prize or portion thereof will be payable according to paragraph (1).
Taxation and Statutory Withholding of Prizes.
Taxes. You are solely responsible for the payment of all taxes and tax reporting to any relevant governmental or other authority on winnings or prizes paid to You by the Lottery. However, the Lottery is required to report certain winning payments to state and federal governments. State and federal withholding taxes will be automatically deducted from prizes meeting statutory thresholds and will be remitted to the appropriate taxing authorities as required by law. The Lottery will use Your Lottery Account information to generate applicable tax forms for reportable gambling and lottery winnings. Certain prizes or portions thereof may be temporarily unavailable or inaccessible while the Lottery processes the tax reporting requirements.
Statutory Offsets. Statutorily required offsets under 23 Pa.C.S.A § 4308 (relating to Lottery winnings intercept for delinquent child support obligations) and 72 P.S. § 215 (relating to Lottery winnings intercept for unpaid tax liabilities and/or court costs and fees) will be automatically deducted from Your Lottery prizes meeting statutory thresholds, and will be paid to the appropriate agencies as required by law. Certain prizes or portions thereof may be temporarily unavailable or inaccessible while the Lottery determines whether You are subject to any of the offsets referenced herein or subsequently imposed by law. - Responsible Gambling.
Self-Exclusion. You have the right to exclude Yourself from accessing or using Your Lottery Account. You may choose a 6-month, 1-year, or a 5-year self-exclusion period. Any period of self-exclusion will become effective immediately upon submission and verification of the self-exclusion request. A self-exclusion request is irrevocable. During any period of self-exclusion, You will be prohibited from logging in to Your Lottery Account to purchase Products or Plays, to utilize Services through the PA iLottery System, to deposit funds in Your Lottery Account, or to withdraw funds from Your Lottery Account. Additionally, during any period of self-exclusion, You will be prohibited from entering Second-Chance Drawings and other events and Promotions offered through the PA iLottery System.
Should You choose to self-exclude, You will be required to acknowledge and agree that: You are requesting self-exclusion voluntarily; self-exclusion applies to Your Lottery Account and may apply to other Products, Promotions and drawings; and You waive and release the Commonwealth, the Lottery and the agents and employees of each from all liability relating to the processing and enforcement of Your self-exclusion.
During a self-exclusion period, You may request withdrawal of moneys from Your Lottery Account. To request a withdrawal of funds from Your Lottery Account during a self-exclusion period, You must contact customer service at 1-833-530-7529 or [email protected].You may be required to provide certain documentation to confirm Your identity or financial information associated with Your Lottery Account and/or Funding Account.
At the conclusion of Your self-exclusion period, Your Lottery Account will not be reinstated automatically. You will be required to contact customer service at 1-833-530-7529 or [email protected] to reinstate Your Lottery Account.
Responsible Gambling Tools. The Lottery offers You responsible gambling tools, including the ability to set limits and cool-off periods.
Cool-Off Periods. You may schedule a cool-off period between 3 days and thirty days. During Your selected cool-off period, You will be prohibited from logging in to Your Lottery Account to purchase Products or Plays, to utilize Services through the PA iLottery System, to deposit funds in Your Lottery Account, or to withdraw funds from Your Lottery Account. Additionally, during any cool-off period, You will be prohibited from entering Second-Chance Drawings and other events and promotions offered through the PA iLottery System. During a cool-off period, You may request withdrawal of funds from Your Lottery Account. To request a withdrawal of funds from Your Lottery Account during a cool-off period, You must contact customer service at 1-833-530-7529 or [email protected]. You may be required to provide certain documentation to confirm Your identity or financial information associated with Your Lottery Account and/or Funding Account. At the conclusion of a cool-off period, Your Lottery Account will be automatically reinstated.
Setting Limits. You may establish limits for Your Lottery Account, including a session time limit; a deposit limit; or a spend limit. A more restrictive limit will go into effect immediately.
A less restrictive limit will go into effect when the current limit expires. - Promotions, Bonuses and Special Offers.
Eligibility. To be eligible for participation in Promotions offered by the Lottery through the PA iLottery System, You must have a valid and verified Lottery Account. If You are self-excluded, You are prohibited from participating in Promotions offered through the PA iLottery System. If Your Lottery Account is suspended or terminated for any reason, You are prohibited from participating in Promotions offered through the PA iLottery System. If You have elected to establish a cool-off period, You are prohibited from participating in Promotions offered through the PA iLottery System during the cool-off period.
Bonus Policy. By agreeing to these Terms and Conditions, You are also explicitly acknowledging and agreeing to the Bonus Policy. The Lottery has established a Bonus Policy, which governs bonuses, Promotions and special offers through the PA iLottery System. This policy may be updated from time to time without prior notice. All PA iLottery System policies or changes thereto are effective upon the date they are published on the PA iLottery System. Your continued use of the PA iLottery System confirms Your agreement to be bound by the revised policies. If You do not agree to the PA iLottery System policies or the revisions thereto, You should discontinue Your use of the PA iLottery System immediately. If there is a conflict between these Terms and Conditions and PA iLottery System policies, these Terms and Conditions will prevail.
PA iLottery System Promotional Rules. The Lottery establishes rules for Promotions, prize drawings and events held through the PA iLottery System. These rules may be updated from time to time without prior notice. All rules or changes thereto are effective upon the date they are posted to the PA iLottery System. Your continued use of the PA iLottery System confirms Your agreement to be bound by the rules or any changes thereto. If You do not agree to the rules or any changes thereto, You should discontinue Your use of the PA iLottery System immediately. If there is a conflict between these Terms and Conditions and PA iLottery System promotional rules, these Terms and Conditions will prevail. - Dispute Resolution.
Customer Service. All disputes concerning Your use of the PA iLottery System should be raised with the Lottery's customer service department at 1-833-530-7529 or [email protected] in a timely manner to allow the Lottery to promptly respond to You.
Lottery Contact. If the Lottery's customer service department is unable or unwilling to resolve a complaint You raised in relation to Your use of the PA iLottery System including any Products or Services offered through the PA iLottery System, You may contact the Lottery via the following email address, [email protected]. Your email should include the following information: Your name; Your address; Your telephone number; Your email address; Your Lottery Account information; the date of the event giving rise to Your complaint; and all supporting documentation. By submitting the complaint, You are consenting to the Lottery contacting You by email at the email address You provided. The Lottery will acknowledge receipt of Your complaint by email. The Lottery will subsequently notify You of the outcome of its review of the complaint.

Outcome of Investigations and Complaints. You understand and agree that the PA Lottery's records are the final authority in determining the events and terms related to investigations and complaints concerning Your Lottery Account. - Privacy Policy.
In addition to these Terms and Conditions, the PA iLottery System Privacy Policy, which can be found at https://www.pailottery.com/p/privacy-policy/ applies to Your use of the PA iLottery System. You should review the Privacy Policy prior to any use of the PA iLottery System. The Privacy Policy describes how Your personal information will be collected, maintained, protected and shared. By agreeing to these Terms and Conditions, You are also explicitly acknowledging and agreeing to the Privacy Policy. This policy may be updated from time to time without prior notice. All changes thereto are effective upon the date they are published on the PA iLottery System. Your continued use of the PA iLottery System confirms Your agreement to be bound by the revised policies. The Lottery hereby grants You a non-exclusive, non-transferable, non-sub licensable, revocable license to access and use the PA iLottery System for individual use through Your Lottery Account in connection with services offered on the PA iLottery System. This license does not include any resale, commercial use or alternative display of the PA iLottery System or any of the functions, text, pictures, graphics, logos, names, trademarks, images or other materials and content displayed on and from the PA iLottery System or any Products, Games, or Services offered through or on the PA iLottery System. - Intellectual Property.
All content appearing on the PA iLottery System, including but not limited to text, images, graphics, logos, illustrations, photographs, descriptions, data, files, scripts, designs, articles, sounds, videos, advertising copy, URLs, technology and software, as well as the format, presentation and organization are owned by the Lottery or third parties who have authorized the Lottery to use them. Your use of the PA iLottery System, or the Products, Games, or Services offered on or through the PA iLottery System, confers no ownership rights or license to use any of the intellectual property or other content beyond the limited license granted by these Terms and Conditions for individual access and use through Your Lottery Account of the PA iLottery System.
If You have reason to believe that any content appearing on the PA iLottery System infringes on Your intellectual property rights, please notify [email protected] and include the following information in Your notice: identify the intellectual property that You claim to own or have rights to; identify the material on the PA iLottery System that may be an infringement of Your ownership or rights with enough detail so that it may be located on the PA iLottery System; a statement by You indicating a good faith belief that the disputed intellectual property is not authorized by the owner, its agent or under the law; a statement by You, declaring under penalty of perjury that the information provided by You in Your notice is accurate; Your address, telephone number and email address; and Your physical or electronic signature. - Prohibited Uses.
By registering for a Lottery Account, You agree that You will not use the PA iLottery System or Your Lottery Account for any purpose other than for purchasing Products, Plays and Services. Violating these Terms and Conditions, engaging in any of the prohibited uses below, or engaging in behavior similar to those outlined below will result in the termination of Your Lottery Account. You are strictly prohibited from:
- Violating state, federal or international laws, regulations, rules or local ordinances during Your use of the PA iLottery System or Your Lottery Account.
- Misrepresenting Your personal identity or personal information, creating a false identity or impersonating any person.
- Circumventing any method or technology the Lottery uses to verify Your age, identity or physical location.
- Using Your Lottery Account to purchase a Product or Play or to utilize a Service while You are not physically located in the Commonwealth of Pennsylvania.
- Allowing any other person or third-party to access or use Your Lottery Account.
- Transferring any funds into Your Lottery Account from Your Funding Account derived from an unlawful or fraudulent activity, including but not limited to money laundering.
- Circumventing any of the Lottery's security measures.
- Attempting to reverse, deny, charge-back, or otherwise block the Lottery's receipt of any funds You have deposited in Your Lottery Account.
- Impersonating another person, business, entity, physical location, or IP address.
- Modifying or interfering with the use or the operation of the PA iLottery System or the Products, Games and Services offered through the PA iLottery System.
- Uploading files to the PA iLottery System with viruses, Trojan horses, worms, corrupted files, or any other disruptive, damaging or harmful files or programs.&
- Gaining or attempting to gain unauthorized access to the PA iLottery System or the Products, Games and Services offered through the PA iLottery System.
- Uploading or transmitting any material that infringes any patent, trademark, service mark, trade secret, copyright or other proprietary rights of any party.
- Modifying, copying, adapting, sublicensing, translating, selling, reverse engineering, decompiling or disassembling any portion of the PA iLottery System, or any of the Products, Games or Services provided through the PA iLottery System.
- Soliciting others to participate or perform unlawful acts through the PA iLottery System, or Your Lottery Account.
- Harassing, abusing, insulting, harming, defaming, slandering, disparaging, intimidating, or discriminating based on race, color, familial status, religious creed, ancestry, age, sex, national origin, handicap or disability, use of guide or support animals because of the blindness, deafness, or physical handicap of another user or because the user is a handler or trainer of support or guide animals.
- Collecting or tracking the personal information of other users through the PA iLottery System or Your Lottery Account.
If the Lottery has reason to believe that You are engaging in any fraudulent, unlawful, or improper use of the PA iLottery System, including, but not limited to money laundering, circumvention of the law or identity theft, the Lottery will immediately suspend or terminate Your Lottery Account and report the suspicious activities to third parties, including law enforcement. - Limitation of Liability.
You acknowledge that Your use of the PA iLottery System is at Your own risk. You further agree that if You disagree with these Terms and Conditions, Your sole and exclusive remedy is to discontinue using the PA iLottery System.
You assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment, such as computer or computer devices, which You use to access the PA iLottery System.
You agree to notify the Lottery immediately if You believe your Lottery Account information, including Your email, password and other Lottery Account information, has been lost, compromised, or stolen, or if You believe that Your Lottery Account has been accessed by someone other than You, by contacting the Lottery at [email protected] or 1-833-530-PLAY (7529). The Lottery is not liable for any damages or losses resulting from a third party"s unlawful or unauthorized use of Your Lottery Account. The Lottery is not liable for any damages or losses resulting from a third party"s unlawful or unauthorized use of any payment source or method, including, but not limited to, debit cards and bank accounts, regardless of whether the payment method is under investigation or whether any card has been reported stolen. It is Your responsibility to keep Your email, password, and other Lottery Account information confidential. If Your email address and password have been entered correctly, You agree that the Lottery is entitled to assume that You are the person using Your Lottery Account. You agree that You are responsible for any charges, costs, expenses, damages, liabilities, and losses of any kind that You, the Lottery, or any third party may incur as a result of Your failure to keep Your Lottery Account information confidential. It is Your responsibility to immediately notify the Lottery if You suspect or discover that Your Lottery Account has been compromised. You agree to cooperate with any investigation into unauthorized access of Your Lottery Account. This Agreement, as amended from time to time, will continue until terminated by one of the Parties as described herein. - Order of Precedence.
Unless stated to the contrary herein, these Terms and Conditions will prevail in the event of a conflict between these Terms and Conditions and any other terms and conditions, Bonus Policy, or rules applicable to the PA iLottery System. - Compliance with Laws.
You agree Your use of the PA iLottery System is subject to all applicable laws, regulations, policies, rules or other authority. - Disclaimer of Representations and Warranties.
As a user, You assume all risks and responsibilities for use or non-use of the PA iLottery System and the content appearing in it. The Lottery makes no representations or warranties of any kind, either express or implied, that content appearing on or downloaded from the PA iLottery System is compatible with Your computer or mobile device or is free from errors or viruses. The PA iLottery System, as well as the content appearing in it, is provided "as is" and "as available." The Lottery makes no representations or warranties of any kind, either express or implied, as to the use, availability, accuracy, appropriateness or performance of the PA iLottery System or any content appearing in it. To the extent permitted by applicable law, all such representations or warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, title or non-infringement, are expressly disclaimed. - Indemnification and Defense.
You agree to defend, indemnify and hold harmless the Lottery, the Pennsylvania Department of Revenue, and the Commonwealth of Pennsylvania and their employees, agents, contractors and suppliers, from and against any and all claims, suits, damages, losses, liabilities, costs and expenses (including attorney fees) arising from or otherwise related to Your use of the PA iLottery System, any content appearing therein, Your Lottery Account, or any violations of these Terms and Conditions. - Governing Law.
Any disputes arising from Your use of the PA iLottery System will be governed by the laws of the Commonwealth of Pennsylvania. You hereby consent to the exclusive jurisdiction of the courts in the Commonwealth of Pennsylvania to resolve any disputes arising out of Your use of the PA iLottery System. - Player Disconnection.
Lost Connection While Playing and Player Input Not Required
In the event that You lose connection to the PA iLottery System while actively playing a Game and Your input is not required to complete a Game, the Game will produce the final outcome as determined by the random number generator and, upon Your reconnection to the PA iLottery System, the Game outcome will be reflected in the Game history table available to You through Your Lottery Account.
Lost Connection While Playing and Player Input Is Required
In the case where end user input is required to complete the Game, the Game will not produce the final outcome and, upon the reconnection of the end user to the network, the end user can return to the Game state immediately prior to the interruption.
Lost Connection While Playing and Failure to Verify Location
In the event that You lose connection to the PA iLottery System after the location service has, at the outset of a playing session, verified Your physical presence in the Commonwealth of Pennsylvania, but, at a later point in the playing session fails to successfully verify Your continued physical presence in the Commonwealth of Pennsylvania, the Game in progress at the time of the subsequent failed location verification will produce its final outcome and Your playing session will be immediately terminated. - General Provisions.
Severability. If any provision of these Terms and Conditions is deemed unlawful or unenforceable for any reason, that provision will be severed from these Terms and Conditions and the remaining provisions will remain in full force and effect.
Waiver. The Lottery is not obligated to take any action or pursue any remedy provided for in these Terms and Conditions. Refraining from taking any authorized action or pursuing any remedy authorized does not constitute a waiver of any rights or remedies and does not preclude the Lottery from taking any such action or pursuing such remedy in the future. - Version and Revision History.
